General Counsel Department of Criminal Justice Information Services 200 Arlington Street, Suite 2200 Chelsea, MA 02150 Dear Attorney Koulouris: I have received the petition of Ardil T. Innis appealing the response of the Department of Criminal Justice Information Services (DCJIS) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 6, 2022, Mr. Innis requested: “the logged time of [an identified Trooper’s access to] criminal history, probation, and driver’s history query of [a certain person] during his October 26, 2010 traffic stop, which resulted in an arrest and conviction…I have a statutory right to the records concerning said crime.” On February 24, 2022, DCJIS responded to Mr. Innis’ request, and provided him with records. As a result of the February 24th response, Mr. Innis petitioned the Supervisor of Records (Supervisor), and this appeal was opened. In his March 3rd petition, Mr. Innis indicates that DCJIS did not provide him with the records he requested. While DCJIS provided Mr. Innis with records, it is unclear whether DCJIS has any additional records responsive to Mr. Innis’ February 6th request. DCJIS must clarify this issue. Conclusion Accordingly, DCJIS is ordered to provide Mr. Innis with response to the request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days.
