Grammel, of the CPCS Strategic Litigation Unit, appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 3, 2022, Attorney Grammel requested the following records involving [identified individuals]: [1] All records of reports related to investigations[;] [2] All use of force reports and/or use of defensive tactics reports filed[;] [3] All internal affairs records and reports[;] [4] All civilian complaints against these [identified individuals], including reports related to investigations involving [identified individuals][;] [5] All documents supporting or relating to such investigations, including the outcome[.] Claiming to not yet have received responsive records, Attorney Grammel petitioned this office and this appeal, SPR22/0725, was opened as a result. Subsequently, a representative of the Department notified a staff member of the Public Records Division they are in the process of fulfilling Attorney Grammel’s request and intend on providing a subsequent response. Accordingly, the Department is ordered to provide Attorney Grammel with said response in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Attorney Grammel may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
