The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records April 13, 2022 SPR22/0797 Mark Rumley Records Access Officer City of Medford City Hall 85 George P. Hassett Drive Medford, MA 02155 Dear Mr. Rumley: I have received the petition of Laura Ortiz appealing the nonresponse of the City of Medford Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 18, 2022, Ms. Ortiz requested records of all public records requests and responses from January 1, 2022-March 18, 2022, including any documentation the School provided with its responses, regarding: 1. Your Oath of Office; 2. Your Surety Bond; 3. The Medford School District Governing Board Members Blanket Bond if applicable; 4. The Power of Attorney for the bond company for your Surety Bond; 5. The Power of Attorney for the Blanket Bond; and, 6. The Fidelity and Liability Insurance Policy, if applicable including and detailing policy number, limits of liability and deductibles, and other mechanism of financial coverage that is in place in the event of a liability claim. Indicating she had yet to receive a response, Ms. Ortiz petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Despite being notified of this appeal, it remains unclear whether the School has provided Ms. Ortiz with a response to her public records request. Accordingly, the School is ordered to provide Ms. Ortiz with a response to her request in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of the response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Ortiz may appeal the substantive nature of the School’s response within ninety (90) calendar days. See 950 C.M.R. 32.08(1).
