Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza Suite 3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Emma Diamond Hall, Esq. of Morgan, Lewis & Bockius LLP on behalf of the Boston Globe appealing the response of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 17, 2022, Attorney Hall requested, “[i]nternal or external analysis, reviews or audits into safeguards for the road testing unit from Jan. 1, 2017 to present.” The Department responded on March 24, 2022. Unsatisfied with the response, Attorney Hall petitioned this office and this appeal, SPR22/0816, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Attorney Hall. Accordingly, the Department is ordered to provide Attorney Hall with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Hall may appeal the substantive nature of the Department's response within ninety days.
