Town Counsel Town of Leicester 3 Washburn Square Leicester, MA 01524 Dear Attorney Rozak: I have received the petition of Joel Hart appealing the response of the Town of Leicester (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 24, 2022, Mr. Hart requested electronic communications between various town officials and a certain consulting group as well as communications between various town officials and certain individuals. The Town provided a fee estimate on April 7, 2022. Unsatisfied with the Town’s response, Mr. Hart petitioned this office and this appeal, SPR22/0832, was opened as a result. In a conversation with a staff attorney in the Public Records Division, the Town indicated that it would provide a supplemental response. Accordingly, the Town is ordered to provide Mr. Hart with a response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hart may appeal the substantive nature of the Town’s subsequent response within ninety days.
