The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records April 12, 2022 SPR22/0849 Helene Bettencourt Records Access Officer Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Marion J. King appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 25, 2022, Ms. King requested the following: A full export of the database(s) containing records of complaints filed with the Problem Resolution System from 1/1/2019 to the date of [the Department’s] response, only in the form in which it is regularly maintained. The Department responded on April 8, 2022, providing responsive records. Unsatisfied with the Department’s response, and indicating it is her contention that the Department possesses additional responsive records, Ms. King appealed, and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the Department provided a supplemental response by email to Ms. King and this office on April 11, 2022. As this appeal was opened based on the Department’s April 8th response, I will now consider this administrative appeal closed. Ms. King may further appeal the substantive nature of the Department’s April 8th response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Marion J. King One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
