G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 29, 2022, Mr. Quemere requested the following records: • The [D]epartment’s current use-of-force policies; • A blank copy of each form used to report use-of-force incidents (if the form is part of a computer program and is not easily exportable, please provide screenshots); • All data on use-of-force incidents that are stored by the [D]epartment’s use-of-force tracking software; please provide the data as a spreadsheet, preferably in Excel format; and • All numerical/statistical reports that can be exported from the [D]epartment’s use-of- force tracking software (e.g., reports showing the total number of incidents per year, the total number of incidents involving each officer, etc.). When the Department did not provide a response, Mr. Quemere petitioned the Supervisor of Records (Supervisor), and this appeal was opened on April 20, 2022. Despite being notified of this appeal, it remains unclear whether the Department has provided Mr. Quemere with a response to his request. Accordingly, the Department is ordered to provide Mr. Quemere with a response to the request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the response within 90 calendar days. See 950 C.M.R. 32.08(1).
