Murray Supervisor of Records April 26, 2022 SPR22/0952; SPR22/0953 Dr. Jahmal Mosley Superintendent of Schools South Hadley Public Schools 116 Main Street South Hadley, MA 01075 Dear Dr. Mosley: I have received the petition of Ben Tobin appealing the nonresponses of the South Hadley Public Schools (School) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 3, 2022, Mr. Tobin filed two public records requests for the following records: • approved schools which allows for certain records pertaining to approved schools if they are first redacted. The Champa vs Weston decision. • … redacted IEPs for students placed in language-based 766 schools … • total number of students in district currently placed in approved special ed schools (766 schools) broken down by placement [and] the MCAS scores for these same students. Claiming to not yet have received a response to the requests, Mr. Tobin petitioned this office and these appeals, SPR22/0952 and SPR22/0953, were opened as a result. Subsequently, I learned that the School intends on providing a written response to Mr. Tobin. Accordingly, the School is ordered to provide Mr. Tobin with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Tobin may appeal the substantive nature of the School’s response within ninety days.
