Berkshire District Attorney’s Office 7 North St. Pittsfield, MA 01201 Dear Attorney Dohoney: I have received the petition of Kyle Christensen appealing the nonresponse of the Berkshire District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 4, 2022, Mr. Christensen requested copies of “police reports, civil motor vehicle crash reports, witness statements, log notes, recorded 911 calls, turret tapes, scene photography or videography, and any citations issued as a result of the Department’s response” relating to “damages sustained in a motor vehicle collision… in the City of Pittsfield on June 7, 2021.” Claiming to not yet have received responsive records, Mr. Christensen petitioned this office and this appeal, SPR22/0976, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. As such, the Office is ordered to provide Mr. Christensen with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Christensen may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
