Murray Supervisor of Records May 10, 2022 SPR22/0977 Brenna McGee City Clerk City of Holyoke 536 Dwight Street, Room 2 Holyoke, MA 01040 Dear Ms. McGee: I have received the petition of Tonisa Nails, Esq. of the Committee for Public Counsel Services appealing the nonresponse of the City of Holyoke (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 5, 2022, Attorney Nails requested: 1. The MFIRS report - Massachusetts Fire Incident Report System for December 4, 2020 between the hours of 9: 30 am to 12 pm [including any information] regarding what apparatus (truck) was sent on the call. 2. A list of all calls that the Holyoke Fire department went on December 4, 2020. 3. A list of all Holyoke dispatch data for December 4, 2020. 4. The daily call log (computer or old-fashioned ledger) for December 4, 2020. 5. The department’s standard operating procedures related to the use of lights and sirens. Claiming to not yet have received responsive records, Attorney Nails petitioned this office and this appeal, SPR22/0977, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the City has provided a response. Accordingly, the City is ordered to provide Attorney Nails with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Attorney Nails may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
