See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests, Mr. Nucera requested the following records on April 11, 2022: [1] All emails written by [named individual] which Mr. Nucera is the subject or topic between August 1, 2020 and April 10, 2022 that the Commission has in its possession[;] [2] All [named individual] emails that were sent or received from the Commission and all affiliated agencies…[;] [3] All emails that were sent or received by [named individual] of the Investigations and Enforcement Bureau as well as [named individual] of the Commission of which Mr. Nucera is the subject and/or topic, between August 1, 2020 and April 10, 2022. Claiming to not yet have received responsive records, Mr. Nucera petitioned this office and the following appeals, SPR22/0978 and SPR22/0979, were opened as a result. In an email dated April 27, 2022, Mr. Nucera informed this office that he wishes to withdraw both administrative appeals. Accordingly, I will consider both administrative appeals closed.
