The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records May 13, 2022 SPR22/1004 Amy Kane Department RAO School Department City of Framingham 150 Concord St. Framingham, MA 01702 Dear Ms. Kane: I have received the petition of Olufunmilola Shelly appealing the response of the City of Framingham School Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 4, 2022, Ms. Shelly requested emails between two named employees and evaluations of one named employee. Prior Appeal The requested records were the subject of a prior appeal. See SPR22/0820 Determination of the Supervisor of Records (April 14, 2022). On April 29, 2022, the Department provided a further response. Unsatisfied with this response, Ms. Shelly petitioned this office and this appeal, SPR22/1004, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Ms. Shelly. Accordingly, the Department is ordered to provide Ms. Shelly with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Shelly may appeal the substantive nature of the Department’s response within ninety days.
