Mazzie Everett Police Department 45 Elm Street Everett, MA 02149 Dear Chief Mazzie: I have received the petition of Steven Fitzgerald appealing the response of the Everett Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 5, 2022, Mr. Fitzgerald requested, “… any and all police reports including videos of the October 25, 2021 incident at Everett City Hall involving [named persons] … Include any statements or reports that involve yourself.” The Department responded on May 5, 2022. Unsatisfied with the Department’s response, Mr. Fitzgerald petitioned this office and this appeal, SPR22/1051, was opened as a result. Subsequently, I learned that the Department provided a further response on May 8, 2022. Where the basis of this appeal was opened as a result of the of the Department’s May 5th response, I will now consider this administrative appeal closed. Mr. Fitzgerald may appeal the substantive nature of the Department’s May 8th response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
