Assistant General Counsel Massachusetts Department of Higher Education One Ashburton Place, Room 1401 Boston, MA 02108 Dear Attorney Nally: I have received the petition of Attorney Steven Ballard of Law Offices of Steven Ballard appealing the nonresponse of the Department of Higher Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 11, 2022, Attorney Ballard requested “…records of applications submitted to the Office of Student Financial Assistance by the Boxborough Police Department/Town of Boxborough, pertaining to the Police Career Incentive Pay Program (PCIPP), prior to January 1, 2010, and any other records related thereto, for the same period of time, all dates prior to January 1, 2010…” Claiming to not yet have received responsive records, Attorney Ballard petitioned this office and this appeal, SPR22/1053, was opened as a result. Subsequently, it is my understanding a representative of the Department provided a response on April 4, 2022 to Attorney Ballard’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed.
