Records Access Officer Department of Conservation and Recreation 251 Causeway Street, 9th Floor Boston, MA 02114 Dear Attorney Tencellent: I have received the petition of Colman Herman appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 22, 2022, Mr. Herman requested “copies of any and all proposals to renovate the early 1900s building the Department owns across from Nantasket Beach in Hull…” Claiming to not yet have received responsive records, Mr. Herman petitioned this office and this appeal, SPR22/1068, was opened as a result. Subsequently, I learned that the Department provided a response on May 10, 2022 to Mr. Herman’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s May 10th response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
