Box 264 Shutesbury, MA 01072 Dear Ms. Bannasch: I have received the petitions of Amanda Alix appealing the nonresponse of the Town of Shutesbury (Town) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests, Ms. Alix requested the following records on April 19, 2022 and April 25, 2022: April 19, 2022 Request [1] Zoom link to the April 14, 2022 finance committee meeting[;] [2] Spreadsheets from FY 2022 and 2023 utilized during the April 14, 2022 finance committee meeting[;] [3] Release notification letter/form to MA DEP from the Town…concerning contamination at test site B-9…and any response by MA Dep regarding this issue. April 25, 2022 Request [1] Massachusetts School Building Assistance (MSBA) program statement of interest form submitted for 2022. Claiming to not yet have received responsive records, Ms. Alix petitioned this office and the following appeals, SPR22/1079 & SPR22/1086, were opened as a result. Subsequently, it is my understanding the Town provided a response on May 11, 2022 to Ms. Alix’s requests. Where these appeal were opened as a result of the Town’s lack of a written response, I will consider this administrative appeal closed. Ms. Alix may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
