King Chief of Police Marblehead Police Department 11 Gerry Street Marblehead, MA 01945 Dear Chief King: I have received your petition on behalf of the Marblehead Police Department (Department) seeking a waiver of statutory limits on fees that may be assessed in responding to a public records request. G. L. c. 66, § 10(d)(iv). As required by law, the Department furnished a copy of this petition to the requestor, Rich Shertenlieb. Id. On April 26, 2022, Mr. Shertenlieb submitted a request seeking various categories of records concerning the Department. In a letter dated May 11, 2022, Mr. Shertenlieb states, “…I agree to this increase… please email me the total and I will come by the station today or tomorrow and pay the invoice.” Conclusion In light of the above, it is unnecessary to opine on the Department’s petition for a waiver of statutory limits on fees that may be assessed in responding to Mr. Shertenlieb’s public records request. Further, this office encourages Mr. Shertenlieb and the City to continue to communicate to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
