Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Ari Ofsevit appealing the nonresponse of the Massachusetts Bay Transportation Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 19, 2022, Mr. Ofsevit requested a “…cost/benefit analysis report for trolley buses and BEBs, as well as other supporting documents or communications which were involved in the drafting of this report.” Claiming to not yet have received responsive records, Mr. Ofsevit petitioned this office and this appeal, SPR22/1094, was opened as a result. Subsequently, I learned that a representative from the Authority provided a response on May 11, 2022 to Mr. Ofsevit’s request. Where the basis of this appeal was opened as a result of the Authority’s lack of a written response, I will consider this administrative appeal closed. Mr. Ofsevit may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, ,' ,,. - ·. ~ Rebecca S.
