Murray Supervisor of Records May 18, 2022 SPR22/1095 Seah Levy Records Access Officer City of Cambridge 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of Brian Grossman, Esq. appealing the response of the City of Cambridge (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 9, 2022, Attorney Grossman requested records “concerning the installation, operation and maintenance of the water main located in the way known as Newall Terrace (a/k/a Newell Terrace) located in Cambridge, Massachusetts.” The City provided a fee estimate on February 25, 2022. Attorney Grossman paid the fee estimate on March 1, 2022. Indicating he had not yet received the records after posting the payment, Attorney Grossman petitioned this office and this appeal, SPR22/1095, was opened as a result. Subsequently, the City informed a staff attorney in this Division that it intends on providing the responsive records. Accordingly, the City is ordered to provide Attorney Grossman with a response in accordance with the Public Records Law, its Regulations, and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Grossman may appeal the substantive nature of the City’s response within ninety days.
