Murray Supervisor of Records May 26, 2022 SPR22/1119; SPR22/1120 Chief Erik Blake Oak Bluffs Police Department 2 Oak Bluffs Avenue Oak Bluffs, MA 02557 Dear Chief Blake: I have received the petition of Rich Saltzberg of Martha Vineyard’s Times appealing the nonresponse of the Oak Bluffs Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests, on April 22, 2022, Mr. Saltzberg requested the following records: [1] All emails between [identified individuals] concerning or related to a missing or rediscovered rifle[;] [2] All emails between [identified individuals] concerning or related to a missing or rediscovered rifle[;] [3] All mobile/cellular telephone records between [identified individuals], from October 1, 2021 to January 31, 2022, for any town phone, any phone paid for by the town, any phone service paid for by the town, any phone or phone service subject to reimbursement by the town, or any phone paid for in total or in part by any task force which the town or its agents are participants. Claiming to not yet have received responsive records, Mr. Saltzberg petitioned this office and the following appeals, SPR22/1119 and SPR22/1120, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Saltzberg with a response to his requests, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Saltzberg may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
