Assistant District Attorney Plymouth County District Attorney’s Office 166 Main Street Brockton, MA 02301 Dear Attorney Cipolletti: I have received the petition of Jose Mercado appealing the nonresponse of the Plymouth County District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 15, 2022, Mr. Mercado requested “…documents, names, officers disciplined, terminated or reprimanded for withholding exculpatory evidence in criminal cases See Brady v. Maryland, 373 U.S.83, 87(1963).” Claiming to not yet have received a response, Mr. Mercado petitioned this office, and this appeal, SPR22/1129, was opened as a result. As of the date of this letter, it is my understanding that the Office has not provided Mr. Mercado a response to his request for records. Accordingly, the Office is ordered to provide Mr. Mercado with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
