Murray Supervisor of Records May 31, 2022 SPR22/1132 Amanda Williams Records Clerk Brookline Police Department 350 Washington Street Brookline, MA 02445 Dear Ms. Williams: I have received the petition of Todd Wallack of WBUR appealing the response of the Brookline Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 12, 2022, Ms. Ferguson requested a “… copy of all internal affairs investigation records for [a named] … officer.” Previous Appeal This request was the subject of a previous appeal. See SPR22/1012 Determination of the Supervisor of Records (May 12, 2022). The Department responded on May 16, 2022. Unsatisfied with the Department’s response, Mr. Wallack petitioned this office and this appeal, SPR22/1132, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Wallack. Accordingly, the Department is ordered to provide Mr. Wallack with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Wallack may appeal the substantive nature of the Department’s response within ninety (90) days.
