John Geary Records Access Officer Lynn Police Department 300 Washington Street Lynn, MA 01902 Dear Lt. Geary: I have received the petition of Andrew Quemere appealing the response of the Lynn Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 17, 2022, Mr. Quemere requested: [1] . . . the investigation report and all records submitted to the Peace Officers Standards and Training Commission [of the investigation of text messages between officers;] [2] . . . all internal affairs records for the eight officers who resigned, or were terminated, or were suspended as a result of the investigation. The Department provided a response on March 17, 2022. Unsatisfied with the Department’s response, Mr. Quemere petitioned this office and this appeal, SPR22/1181, was opened as a result. Previous Appeal This request was the subject of a previous appeal. See SPR22/0355 Determination of the Supervisor of Records (February 18, 2022). In my February 18th determination, I learned that the Department provided Mr. Quemere with a response dated February 14, 2022 and closed the appeal. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Quemere. Accordingly, the Department is ordered to provide Mr. Quemere with a response to his request in a manner consistent with the Public Records Law, its Regulations, and this order within ten (10) business days.
