Box 252 Edgartown, MA 02539 Dear Sheriff Neville: I have received the petition of Karina Wilkinson appealing the nonresponse of the Dukes County Sheriff’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 4, 2022, Ms. Wilkinson requested the following: [1] Documents containing inmate calling service (ICS) provider phone rates and site commission percentage, as well as the current contract for inmate calling service in correctional facilities in the county…[;] [2] Revenues, call minutes, call volumes, and commission totals for the period August 1, 2021 through February 28, 2022[;] [3] Any documents indicating whether video visitation has been implemented, and any documents or amendments indicating rates and commissions for video visits…[.] Claiming to not yet have received responsive records, Ms. Wilkinson petitioned this office and this appeal, SPR22/1191, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. As such, the Office is ordered to provide Ms. Wilkinson with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Ms. Wilkinson may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
