Murray Supervisor of Records June 6, 2022 SPR22/1210 Chief William Bernat Palmer Fire Department 12 Walnut Street Palmer, MA 01069 Dear Chief Bernat: I have received the petition of Mariem Marquetti, Esq. of Murphy, Hesse, Toomey & Lehane, LLP appealing the nonresponse of the Palmer Fire Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 21, 2022, Attorney Marquetti requested, “… all documentation… regarding the annexation by the Fire Department for territory belonging to the Thorndike District [including] Annexation, dated May 26, 1992, Article 12 [ and] Annexation, annual meeting 1958, Article 11.” Claiming to not yet have received responsive records, Attorney Marquetti petitioned this office and this appeal, SPR22/1210, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Marquetti with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Attorney Marquetti may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
