See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 6, 2022, Mr. Graver filed a public records request for “a copy of the Bird scooter contract for the city of Pittsfield, and emails related to procurement.” On May 9, 2022, Mr. Graver clarified his request to include: [a]ny contracts between the city and Bird scooters including revenue sharing agreements…[and] [a]ny emails or other forms of communication that would be considered public records at the date of this request related to the implementation, roll out, deployment, press releases, marketing materials, or other communications from any department related to the Bird scooters. On May 23, 2022, the City responded. Unsatisfied with the City’s response, Mr. Graver petitioned this office and this appeal, SPR22/1228, was opened as a result. Subsequently, I learned that the City responded to Mr. Graver’s request with a further response sent on June 6, 2022. I will now consider this administrative appeal closed. Mr. Graver may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
