LaBombard City Clerk City of Easthampton 50 Payson Ave Easthampton, MA 01027 Dear Ms. LaBombard: I have received the petition of Shelby Lee appealing the response of the City of Easthampton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 6, 2022, Ms. Lee requested the following: 1. Any and all receipts, emails, and documents pertaining to the transfer or designation of city funds, including grant funding, to any and all non-profit organizations including date money was assigned, date money was given, and amount given. 2. Name of person or persons who represented the non-profit organization to city hall. On May 12, 2022, the City responded and provided a further response on May 19, 2022. Unsatisfied with the City’s responses, Ms. Lee petitioned this office and this appeal, SPR22/1262, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Lee. Accordingly, the City is ordered to provide Ms. Lee with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Lee may appeal the substantive nature of the City’s response within ninety days.
