Director of Public Records City of Boston 1 City Hall Square, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Andrew Ryan of the Boston Globe appealing the response of the Boston Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2022, Mr. Ryan requested “digital scans (preferably PDFs) of all Boston Police Department Form # 2000 – Homicide Information Sheet from Jan 1, 1970 up until today.” The Department began providing records on a rolling basis, starting on March 11, 2022. Previous Appeal This request was the subject of a previous appeal. See SPR22/1031 Determination of the Supervisor of Records (May 13, 2022). In my May 13th determination, I ordered the Department to clarify how the responsive records constitute the type of reports contemplated under G. L. c. 41, § 97D, or the type of daily log described in G. L. c. 41, § 98F, or the type of record contemplated under G. L. c. 209A, § 8. Additionally, I ordered the Department to clarify how Exemption (c) applies to the information redacted from numerous records. In a letter to this office on June 9, 2022, an attorney for the Boston Globe states that the Department “has continued to produce request-related records on a rolling basis; however, [the Department] continues to withhold records on the same grounds.” Accordingly, the Department is again ordered to provide Mr. Ryan a response in a manner consistent with this order, the May 13th determination described above, the Public Records Law, and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Failure to comply with this order may result in referral of this matter to the Office of the Attorney General. See G. L. c. 66, § 10A (b).
