Murray Supervisor of Records June 21, 2022 SPR22/1355 Michele Benjamin City Clerk City of Pittsfield 70 Allen Street Pittsfield, MA 01201 Dear Ms. Benjamin: I have received the petition of Matt Graver appealing the response of the City of Pittsfield (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 6, 2022, Mr. Graver filed a public records request for “a copy of the Bird scooter contract for the city of Pittsfield, and emails related to procurement.” On May 9, 2022, Mr. Graver clarified his request to include: [a]ny contracts between the city and Bird scooters including revenue sharing agreements…[and] [a]ny emails or other forms of communication that would be considered public records at the date of this request related to the implementation, roll out, deployment, press releases, marketing materials, or other communications from any department related to the Bird scooters. Prior Appeal The requested records were the subject of a prior appeal. See SPR22/1228 Determination of the Supervisor of Records (June 8, 2022). The City provided a further response on June 6, 2022. Unsatisfied with this response, Mr. Graver petitioned this office and this appeal, SPR22/1355, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Graver. Accordingly, the City is ordered to provide Mr. Graver with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days.
