The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records June 17, 2022 SPR22/1393 Superintendent Priya Tahiliani Everett Public Schools 121 Vine Street Everett, MA 02149 Dear Superintendent Tahiliani: I have received the petition of Ben Tobin appealing the nonresponse of the Everett Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 28, 2022, Mr. Tobin requested School policies, procedures and any documents related to an identified education program. Claiming to not yet have received responsive records, Mr. Tobin petitioned this office and this appeal, SPR22/1393, was opened as a result. Subsequently, I learned that a representative of the School notified this office that the proper agent for handling public record requests never saw the inquiry as it was sent to an incorrect address. Mr. Tobin should note that public record requests to the School should be sent to: City of Everett Public Schools 121 Vine Street Everett, MA 02149 ptahiliani@everett.k12.ma.us The School has been provided with Mr. Tobin’s request. Accordingly, the School is ordered to provide Mr. Tobin with a response in accordance with the Public Records Law and its Access Regulations within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Tobin may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1). One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
