Murray Supervisor of Records June 27, 2022 SPR22/1407; SPR22/1408 Allison Mondello Primary RAO Office of the Chief Legal Counsel Massachusetts State Police 50 Maple Street Milford, MA 01757 Dear Ms. Mondello: I have received the petitions of Wayne Napolitano appealing the nonresponse of the Massachusetts Department of State Police (Department) to two requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 2, 2021, Mr. Napolitano made two requests for an incident report relating to the 1982 death of an identified person. Each request referenced a different individual whom Mr. Napolitano named as having a “… relation to the incident.” Claiming to not yet have received responsive records, Mr. Napolitano petitioned this office and these appeals, SPR22/1407 and SPR22/1408, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Napolitano with a response to his requests, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Napolitano may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
