Assistant General Counsel Records Access Officer Massachusetts Department of Transportation 10 Park Plaza Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Michael Saccone of Boston 25 News appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 18, 2022, Mr. Saccone requested, “[e]xit interviews for all MBTA Transit Police a MBTA officers who left the department in 2021.” Previous appeals This request was the subject of previous appeals. See SPR22/0209 Determination of the Supervisor of Records (February 14, 2022); SPR22/0659 Determination of the Supervisor of Records (April 4, 2022) and SPR22/0998 Determination of the Supervisor of Records (May 11, 2022 and June 8, 2022). The MBTA responded on June 10, 2022. Unsatisfied with the response, Mr. Saccone petitioned this office and this appeal, SPR22/1435, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a MBTA representative, it is my understanding that the MBTA intends on providing a further response to Mr. Saccone. Accordingly, the MBTA is ordered to provide Mr. Saccone with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Saccone may appeal the substantive nature of the MBTA's response within ninety days.
