Murray Supervisor of Records July 5, 2022 SPR22/1441 Captain Scott Stallbaum Everett Police Department 45 Elm Street Everett, MA 02149 Dear Captain Stallbaum: I have received the petition of Wayne Napolitano appealing the nonresponse of the Everett Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 3, 2022, Mr. Napolitano requested a record of all internal affairs complaints and lawsuits filed against an identified individual during his time as a Department officer. Claiming to not yet have received a response, Mr. Napolitano petitioned this office, and this appeal, SPR22/1441, was opened as a result. Subsequently, I learned that the proper agent for handling public records request never received the inquiry as it was sent to an inactive email account. The correct address for public records requests to the Department is as follows: Captain Scott Stallbaum Everett Police Department 45 Elm Street Everett, MA 02149 foia@cityofeverett.org Accordingly, the Department is ordered to provide Mr. Napolitano with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days.
