G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 24, 2022, HWPublicRecords requested, “… all emails sent by [named person] … to any school committee members [and] … all emails [named person] has sent or received as a member of the School Committee. Essentially all communications via email in entirety.” The School responded on March 28, 2022. Unsatisfied with the School’s response, HWPublicRecords petitioned this office and this appeal, SPR22/1444, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a School representative, it is my understanding the School intends on providing a further response to HWPublicRecords. Accordingly, the School is ordered to provide HWPublicRecords with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. HWPublicRecords may appeal the substantive nature of the School’s response within ninety (90) days.
