Murray Supervisor of Records July 7, 2022 SPR22/1450 Allison Mondello Primary RAO Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Mikhael El-Bayeh appealing the response of the Department of Massachusetts State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 27, 2022, Mr. El-Bayeh requested five (5) categories of records concerning the Department and its cruisers. Prior appeal The responsive records were the subject of a prior appeal. See SPR22/1131 Determination of the Supervisor of Records (May 31, 2022). I closed my May 31st determination ordering the Department to provide a response in accordance with the order, the Public Records Law and its Regulations. On June 3, 2022, the Department responded. Unsatisfied with the response, Mr. El-Bayeh petitioned this office and this appeal, SPR22/1450, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. El-Bayeh. Accordingly, the Department is ordered to provide Mr. El-Bayeh with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. El-Bayeh may appeal the substantive nature of the Department’s response within ninety days.
