The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records July 11, 2022 SPR22/1475 Kevin O’Donnell City of Everett Office of the Mayor 484 Broadway Everett, MA 02149 Dear Mr. O’Donnell: I have received the petition of Steven Fitzgerald appealing the response of the City of Everett Office of the Mayor (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 9, 2022, Mr. Fitzgerald requested “…a copy of the three (3) zoom meeting tapes received by Mayor Carlo DeMaria on or about March 28, 2022. Also include in this request, any response forwarded to the sender of those tapes.” Claiming to not yet have received responsive records, Mr. Fitzgerald petitioned this office and this appeal, SPR22/1475, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the City has provided a response. As such, the City is ordered to provide Mr. Fitzgerald with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Fitzgerald may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
