Sullivan Town Clerk Town of Lenox 6 Walker Street Lenox, MA 01240 Dear Ms. Sullivan: I have received the petition of Attorney Mitchell I. Greenwald appealing the nonresponse of the Town of Lenox (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 9, 2022, Attorney Greenwald requested the following records: 1. Any document constituting or concerning the records retention policy applicable to surveillance videos…[;] 2. Any document concerning a records request made by [a named individual] dated March 29, 2022…[;] 3. Any document concerning the grievance letter sent by [a named individual] on May 16, 2022, to [a named individual]…[;] 4. Any documents constituting, reflecting, or discussing the establishment of a complaint procedure or process contemplated in… [a specific subjection of an identified manual]…[;] 5. Any document concerning the subject of a meeting between [identified individuals] on or about March 23, 2022, including… records of communication between any party and [a named individual] concerning or reflecting the activities that were referred to in a letter from [a named individual] to [a named individual] dated March 23, 2022, or forming any portion of the basis of evidence for the claims made by [a named individual] in such meeting or in said letter. Claiming to not yet have received responsive records, Attorney Greenwald petitioned this office and this appeal, SPR22/1486, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response.
