Deputy General Counsel Department of Energy Resources 100 Cambridge Street, Suite 1020 Boston, MA 02114 Dear Attorney Evans: I have received your petition on behalf of the Department of Energy Resources (Department) requesting an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(c). On June 17, 2022, Kaitlin Kelly O’Neill requested copies of “. . . customer allocation forms submitted as documentation for qualified Community Shared Solar projects in both the Solar Carve-out II and the SMART programs. . .” In an email to this office dated June 29, 2022, Ms. O’Neill states, “[w]e accept the time extension and will be providing the requested fee to Ms. Evans promptly to complete this request.” Conclusion In light of the above, it is unnecessary to opine on the Department’s petition for an extension of time to produce records and waiver of statutory limits on fees that may be assessed in responding to a public records request.
