The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 19, 2022 SPR22/1524 Cara Dahill Town Clerk Town of Carver 108 Main Street Carver, MA 02330 Dear Ms. Dahill: I have received the petition of Ivria Fried, Esq., of Miyares and Harrington LLP, appealing the response of the Town of Carver (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 22, 2022, Attorney Fried requested, “[t]he Order of Conditions issued to [named developer], for [named address], [developer’s] NOI, the minutes of the June 15th meeting (in draft is not yet approved) and all communications to or from the Commission in reference to [the developer’s] application.” On June 22, 2022, the Town responded. Unsatisfied with the Town’s response, Attorney Fried petitioned this office and this appeal, SPR22/1524, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Attorney Fried. Accordingly, the Town is ordered to provide Attorney Fried with a response to her request in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Fried may appeal the substantive nature of the Town’s response within ninety days.
