The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 22, 2022 SPR22/1575; SPR22/1578 Janice E. Thompson, Esq. Assistant City Solicitor Law Department City of Worcester 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Staisha Chavis appealing the responses of the Worcester Police Department (Department) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 18, 2022, Ms. Chavis requested the “[p]olice report and/or incident report involving [a named individual] said incident occurred on Grosvenor Street between the dates of 6/13/22-6/16/22.” On June 21, 2022, Ms. Chavis requested “[a]ny and all police report(s) filed in connection to an incident involving [a named individual] said incident occurred on King Street, Worcester.” On June 28, 2022, the Department responded. Unsatisfied with the Department’s responses, Ms. Chavis petitioned this office and these appeals, SPR22/1575 and SPR22/1578, were opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Ms. Chavis. Accordingly, the Department is ordered to provide Ms. Chavis with a response to her requests in a manner consistent with the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Chavis may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
