The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 25, 2022 SPR22/1601 Jacqueline Cook Records Access Officer Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Ms. Cook: I have received the petition of Erin Stewart, of Citizens for Juvenile Justice, appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 12, 2022, Ms. Stewart requested eight (8) categories of documents concerning school-related arrests and referrals. Claiming to not yet have received a response, Ms. Stewart petitioned this office, and this appeal, SPR22/1601, was opened as a result. Subsequently, I learned that the Department is working on a response. In an email to this office dated July 22, 2022, the Department states, “[t]he first time I saw this request was when you sent it for nonresponse. It is quite a lengthy request and will take some time to compile. The [Department’s] response will be coming soon.” Accordingly, the Department is ordered to provide Ms. Stewart with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
