The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 26, 2022 SPR22/1615 Captain Matthew LeMay Fitchburg Police Department 20 Elm Street Fitchburg, MA 02780 Dear Captain LeMay: I have received the petition of Erin Stewart, of Citizens for Juvenile Justice, appealing the nonresponse of the Fitchburg Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 11, 2022, Ms. Stewart requested records pertaining to school based arrest data. Claiming to not yet have received a response, Ms. Stewart petitioned this office, and this appeal, SPR22/1615, was opened as a result. Subsequently, I learned that the Department provided Ms. Stewart with a response to her request dated July 19, 2022. Where the basis of this appeal was as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Stewart may appeal the substantive nature of the response within 90 days. See 950 C.M.R. 32.08(1).
