The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 19, 2022 SPR22/1623 Kate Silvia Director of Communications Massachusetts Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of David Weimer, of Muck Rock News, appealing the nonresponse of the Massachusetts Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 21, 2022, Mr. Weimer requested, “…records, all of which were provided to the Ripples Group … of the ‘Strategic Plan for Women Who Are Incarcerated in Massachusetts’.” Additionally, Mr. Weimer requested the following records: [1] A database of currently incarcerated women at MCI-Framingham, including age, race, offense, sentence, zip code of home community, number of children reported by women (no names) [2] A database of staff at MCI-Framingham, including positions, gender, race . . .; [3] Historical breakdown of the population at MCI-Framingham by sentence types (i.e., state/county/pretrial/civil/federal); [4] Program participation and visitations at MCI-Framingham; [5] Financials on MCI-Framingham[;] [6] [O]ther reports and files, many related to facility conditions. Claiming to not yet have received responsive records, Mr. Weimer petitioned this office and this appeal, SPR22/1623, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Weimer with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Weimer may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
