Conti, Ph.D. Superintendent Burlington Public Schools 123 Cambridge Street Burlington, MA 01803 Dear Superintendent Conti: I have received the petition of Matt Magnarelli appealing the nonresponse of the Burlington Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. Magnarelli requested, “…any emails that include correspondence between the above mentioned 3 public employees … from the Sept 1st, 2021, onward to the date 6/26/22.” Claiming to not yet have received responsive records, Mr. Magnarelli petitioned this office and this appeal, SPR22/1626, was opened as a result. Subsequently, I learned that the School provided Mr. Magnarelli with a response to his request dated July 14, 2022. Where the basis of this appeal was opened as a result of the School’s lack of a written response, I will now consider this administrative appeal closed. Mr. Magnarelli may appeal the substantive nature of the School’s response within 90 days. See 950 C.M.R. 32.08(1).
