Legal Counsel Department of State Police Crime Laboratory 124 Acton Street Maynard, MA 01754 Dear Attorney Miller: I have received the petition of Edwin R. Novas appealing the response of the Department of State Police Crime Laboratory (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 24, 2022, Mr. Novas requested three categories of records concerning a specific prosecution and a named individual. The Department responded on June 16, 2022, denying the request. Unsatisfied with the Department’s response, Mr. Novas appealed, and this case was opened as a result. Based on an email from the Department to this office on July 20, 2022, I understand that the Department intends to provide a supplemental response to Mr. Novas. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Novas may appeal the substantive nature of the Department’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
