The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 1, 2022 SPR22/1704 Lieutenant Marie Cleary Wellesley Police Department 485 Washington Street Wellesley, MA 02482 Dear Lieutenant Cleary: I have received the petition of Celeste Demarco appealing the response of the Wellesley Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Ms. Demarco requested “…an application for criminal complaint regarding 2054CR000028, and any police reports supporting it, including witness statements, memoranda recording interviews, notes, and the like.” On July 25, 2022, the Department provided a response indicating that it is in possession of a police report and application for criminal complaint. The Department withheld the police report and redacted criminal complaint under the Criminal Offender Record Information Act as it operates through Exemption (a). As a result, Ms. Demarco petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Conclusion Accordingly, in an email dated August 1, 2022, Ms. Demarco states, “I was able to obtain the documents through another means. Thanks for your willingness to help but we no longer need to continue with the appeal. In light of Mr. Demarco’s August 1st email, I will now consider this administrative appeal closed.
