Box 351 Rowley, MA 01969 Dear McClenaghan: I have received the petition of Timothy Toomey appealing the response of the Town of Rowley (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. Toomey indicates that he did not receive the complete email records regarding the Town of Rowley’s Public Records Request No. 2202-45, pertaining to the Zoning Board of Appeals. The Town provided Mr. Toomey with certain of the email records; however, on July 27, 2022, Mr. Toomey petitioned the Supervisor of Records (Supervisor), and this appeal was opened. In his July 27th petition, Mr. Toomey indicates that, “…I did not receive the complete records. I sent an email to [the Board of Appeals] requesting the written decision before they filed with [the] [C]lerk. This never appeared in their records produced. It was not a regular email, I’m sure it was thr[ough] their internet site between [M]ay 4 and [M]ay 25, 2022 contact procedure.” After this appeal was opened, on August 2, 2022, the Town provided Mr. Toomey with the May 9, 2022 email that he sought in his request, and that the Town did not initially provide. Accordingly, where the Town has now provided Mr. Toomey with the responsive email record, I will consider this administrative appeal closed.
