The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 3, 2022 SPR22/1733 Kristen Campbell Records Access Officer Lakeville Police Department 323 Bedford Street Lakeville, MA 02347 Dear Ms. Campbell: On July 28, 2022, this office received your petition on behalf of the Lakeville Police Department (Department) seeking a waiver of statutory limits on fees that may be assessed in responding to a public records request. G. L. c. 66, § 10(d)(iv). On July 13, 2022, Attorney Douglas Snook, of Snook Law Office, requested “…copies of all motor vehicle accident reports concerning any motor vehicle accidents which occurred in your jurisdiction from May 1, 2022 to June 30, 2022.” Attorney Snook’s July 13th request was the subject of a previous determination. See SPR22/1621 Determination of the Supervisor of Records (July 21, 2022). In that determination, I found the Department did not demonstrate that it furnished a copy of its petition to the requestor as required under G. L. c. 66, § 10(d)(iv)(2). Conclusion Whereas a determination was issued on this matter, it is unnecessary to opine on the Department’s petition for a waiver of statutory limits on fees for responding to the public records request.
