The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 8, 2022 SPR22/1749 Dennis Farias City Clerk City of New Bedford 133 William Street New Bedford, MA 02740 Dear Mr. Farias: I have received the petition of Grace Ferguson of New Bedford Light appealing the nonresponse of the City of New Bedford (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 14, 2022, Ms. Ferguson requested: - Records showing the location of every lead water main and service line in New Bedford that the city is aware of. - Records showing the addresses of every home where a water sample has been taken for the purpose of EPA-required lead analysis, including the date and test results of each sample, since 2017. Claiming to not yet have received responsive records, Ms. Ferguson petitioned this office and this appeal, SPR22/1749, was opened as a result. Subsequently, I learned that the City provided Ms. Ferguson with a response dated August 3, 2022. Where the basis of this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Ms. Ferguson may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
