G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 21, 2022, Mr. Herman requested the “… DCR LARF form.” Previous Appeals The records sought by Mr. Herman were the subject of previous appeals. See SPR22/0912 Determination of the Supervisor of Records (May 2, 2022) and SPR22/1231 Determination of the Supervisor of Records (June 9, 2022). The Department responded on July 29, 2022. Unsatisfied with the Department’s response, Mr. Herman petitioned this office and this appeal, SPR22/1752, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Herman. Accordingly, the Department is ordered to provide Mr. Herman with said response to the request in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of Department’s response within ninety days.
